Civil Partnership Solicitors

Civil Partnerships were introduced in December 2005. A Civil Partnership can be entered into by a same-sex couple and in all but name is gay marriage. Since their introduction, there have been a significant number of Civil Partnerships and they have understandably proved to be extremely popular.

For people who may be contemplating entering into a Civil Partnership with their partner, they may wish to secure legal advice beforehand for clarification as to the legal implications of such a commitment. Some people may wish to seek the protection of a pre-partnership agreement which has the same impact of a pre-nuptial agreement. We have experience of preparing pre-partnership agreements for same-sex couples. Although pre-nuptial agreements are not binding under present English law, where they have been properly drawn up and meet the appropriate safeguards, the courts will attach a great deal of weight to the contents of such agreements when relationships break down.

Since the introduction of Civil Partnerships in December 2005, there have been no significant reported court cases where there have been financial disputes between separating couples. The law relating to divorce is broadly similar to the law in respect of Civil Partnerships, although at present it is not known how the long history of divorce case law will be applied to Civil Partnerships. It is anticipated that the same principles will apply, although there is a great deal of uncertainty at present.
